The Supreme Court on Monday agreed to hear plea seeking a direction to the Union of India through its Ministries and Department of Military Affairs for reconsideration of the ‘Agnipath’ Scheme.
After recess, the subject was scheduled for hearing by a bench consisting of Justices Indira Banerjee and JK Maheshwari.
Numerous PILs have been filed with the Supreme Court following recent protests against the Agnipath Scheme in various regions of the nation.
The current petition asks for guidance on how to set up a committee to advise the Ministry of Defence's Department of Military Affairs and to solicit suggestions from interested parties, military job candidates, and retired army officers for changes to the Agnipath Scheme that would give 75% of Agniveers post-retirement employment opportunities.
The petition claimed that it is an incomplete reform with several implications. The plea stated,
"There are various shortcomings in this reform and with further discussion, it would have been executed as a better reform. But as usual, it was pushed from the top by politicians and bureaucrats with 3 chiefs left to defend the indefensible."
The PIL further mentions the huge outcry that followed the announcement of the programme in numerous states of the nation, including Bihar, UP, Haryana, Telangana, Uttrakhand, West Bengal, etc.
Another Public Interest Litigation was filed before the Supreme Court in a similar vein, requesting guidance on how to set up a Special Investigation Team to look into the violent demonstrations against the "Agnipath Scheme.
Another Public Interest Litigation opposing the Agnipath Scheme has also been submitted to the Supreme Court by Advocate ML Sharma, who claims that the notification's violation of the Constitution has caused serious harm to Indian citizens, including the Indian army, that cannot be undone if it is not quashed.
